Terms and Conditions of Sale
Please read them carefully
Buyer, by placing an order, makes an offer to purchase pursuant to these terms and conditions, which offer, if accepted by ADORE TACKLE, is accepted within the State of South Australia, and buyer consents to the jurisdiction of the courts of the State of South Australia for the limited purpose of dispute arising between the parties resulting from this transaction and agrees that the laws of the State of South Australia shall apply.
By opening or using a product purchased from ADORE TACKLE, the buyer agrees to be bound by the term and conditions of sale as set forth below. If you do not agree to the terms and conditions of sale, please ship the product back to ADORE TACKLE unopened within 5 days of receipt for a full refund (less shipping and handling charges).
ADORE TACKLE makes no warranty, either expressed or implied, of merchantability or fitness for any particular purpose, and none shall be implied by law.
Final determination of suitability of any item sold for the use contemplated by buyer is the sole responsibility of the buyer, and Seller shall have no responsibility in connection with such determination.
ADORE TACKLE will not be responsible for any consequential or incidental damages resulting from the sale, non-delivery, use or improper function of any equipment purchased from us. The responsibility, if any is imposed, of ADORE TACKLE in regard to any item purchased shall be limited to the monetary value of the merchandise purchased.
ADORETACKLE.com is intended to be a guide only. Some item illustrations are for display purposes only, may not be exact, and are not necessarily included in the purchase price. ADORE TACKLE is not responsible for typographical or pictorial errors, and specifications may change without notice.
All items offered for sale are subject to availability. Many items on our Web site come from various sources. ADORE TACKLE is, therefore, bound to fluctuating currency exchange rates, making it necessary to occasionally change prices. In addition, some domestic and overseas products may be discontinued without our prior knowledge. Should this apply to your order, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
All orders placed are subject to confirmation and acceptance by ADORE TACKLE.
Order confirmation given to you through ADORETACKLE.com does not guarantee our acceptance of your order, nor does it constitute confirmation of an offer to sell. ADORE TACKLE reserves the right to decline and cancel an order, or supply less than quantity ordered at any time.
To avoid mistakes and improve efficiency, orders should be placed only using our on-line ordering system.
Quantity in stock is updated automatically online, but does not take into account any manual placed ordered which are yet to be processed.
Any attempt to cancel an order must be made as soon as possible. Cancellations attempted after the order has been dispatched will result in the buyer having to pay the shipping and handling charges on the package and the cost of shipping the package back.
Cancellations may be communicated by email.
We make every effort to provide you with an error-free website. However, in the event there is a misprint, we reserve the right to correct copy or pricing to reflect the actual current status.
At times, we may experience a shortage of certain items. At these times, we reserve the right to restrict the quantity of a particular item ordered. We will notify you if a situation like this occurs, In addition, ADORE TACKLE may, at its own discretion, limit quantities sold in each order or to each buyer.
For any online orders, accepted payments include credit cards (Visa/Master card ONLY, PAYPAL and AfterPay)
ADORE TACKLE reserves the right to perform checks for orders paid using credit card, and we may request photo identification to be supplied for large value orders.
For security reasons, ADORE TACKLE recommends that any orders greater than $500 are paid using PayPal.
'First time buyers' with order values higher than 400$ must pay via PayPal only. Credit card payments for these orders might not be accepted without prior arrangement.
The title of the goods supplied does not pass to the buyer from ADORE TACKLE until the full amount is paid.
We do not ship to PO boxes unless that address is known and can be verified by ADORE TACKLE.
ADORE TACKLE will make every effort to deliver on time.
Our Free Shipping policy allows for Only 1 Attempted Delivery per order. Buyers are responsible to have someone at the delivery address to sign for and accept the delivery. In case the delivery address is unattended at the time of delivery, a "pick-up from Depo" notice will be left by the driver. Buyers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods.
You can leave an ‘authority to leave’ comment when placing your order (not applicable to rods). If you do, you understand and agree that this 'authority to leave' gives us and/or our selected couriers permission to leave your order unattended at the front door of the delivery address mentioned in the order, without obtaining a signature confirming that delivery has reached you. The responsibility and liability for proof of delivery is transferred to you once your order has been dropped off as per your instructions.
All ADORE TACKLE products come with guarantees that cannot be excluded under the Australian Consumer Law. The buyer is entitled to a replacement or refund for a major failure, as long as that major failure is due to manufacturing defects.
ADORE TACKLE warrants that any purchased merchandise is free from defect in workmanship and materials under normal use and service. This warranty is not transferable. ADORE TACKLE will make good, by repair, or at its option, by replacement, defects which, under proper use in ADORE TACKLE’s opinion, appear in the merchandise within a period of twelve (12) months from the date of original goods delivery (“Warranty Period”).
This warranty doesn't cover normal wear and tear, external influences, weather conditions, incorrect handling and misuse and it's also not applicable to items of consumable nature.
Let’s explain this a little bit:
For fishing rods:
ADORE TACKLE warrants against STRUCTURAL DEFECTS (we call this “non-conformances in materials and workmanship”) in the rod blank for all brands that we represent. If the rod blank fails STRUCTURALLY then ADORE TACKLE will replace the rod at no charge. “Structural failure” means that something in the rod blank was defective when the rod was made and the rod broke due to this defect. No, this DOES NOT INCLUDE rods broken by rod lockers, overhead fans, door jams, eskies traveling on a boat, big butts, big shoes or boots, irate partners, misuse, alterations, accidents or other calamities that are “human created” rather than a structural failure. Nor does this warranty include rod guides, ceramic inserts in the guides, or tip tops.
It’s very important that you understand how this Warranty works before you purchase any of our products. All our products have a “Warranty” but in almost all cases the warranty covers ONLY defects that were inherent in that product when it was manufactured and do not include incidental damage that occurred after the product was purchased
Examples when warranty might be void:
- damage caused by the buyer’s negligence, lack of maintenance, accident or abuse, or incorrect use including; high sticking, dropping, impacts, misalignment of reel with rings, improper alignment of tongue-and-groove (spigot joints) sections, incorrect attachment of parts, etc.
- breakage due to rod being used with line heavier than that the rod is recommended for
- breakage due to rod being used with cast weight heavier than that the rod is recommended for
- normal expected wear
- damage due to modifications or repairs
- damages due to the intentional breakage or incidents caused by other than fishing
- loss or damage due to a natural disaster, fire, theft or any other events of force
- where there is no proof of purchase (invoice or receipt) of the product
- where the rod was purchased second hand
- products that have been repaired/ serviced/modified by non-authorized service technicians before being submitted to warranty assessment
As a general rule, rod breakage is very rarely a manufacturing fault or flaw. For most our suppliers, the instances are well below 1%.
For fishing reels:
ADORE TACKLE warrants against MANUFACTURING DEFECTS (we call this “non-conformances in materials and workmanship”) in the reels for all brands that we represent. If the reel fails due to MANUFACTURING DEFECTS, then ADORE TACKLE will replace the reel at no charge (excluding shipping). “Manufacturing defects” means that something in the reel was defective when the reel was made, and the reel is not working/performing due to this defect. Example will include faulty, broken or bent bearings, pinions, bails, springs, shafts, etc (faulty before shipment of that respective reel to the Buyer). No, this DOES NOT INCLUDE reels broken by falling on the floor, reels being smashed by heavy objects on a boat or elsewhere, misuse, alterations, other accidents or other calamities that are “human created” rather than a manufacturing defect. Abuse, improper use, dirt, rust or normal scratching or wear marks will not be covered under this warranty policy
Examples when warranty might be void:
- Damage or malfunctions caused by the owner's negligence, lack of maintenance, accident or abuse
- Normal expected wear
- The reel has been used with fishing line above its maximum drag force or above recommended by manufacturer (written on the side of the reel). When only the later available, spool capacity has to be read as maximum allowed monofilament line on that particular reel (no braid).
- Products that have been subjected to unauthorized alterations including opening of any reel sides, repairs (or attempted repairs) or modifications
- Products that have been repaired/ serviced/modified by non-authorized service technicians before being submitted to warranty assessment
All products returned for manufacturer's warranty claim (as long as they have been used) have to go through warranty assessment to determine if manufacturer's warranty is valid. To submit a product for manufacturer's warranty assessment, please pack all parts of the rod (all parts - broken or not) and send it to our warehouse address: ADORE TACKLE address: 53 O.G. ROAD, KLEMZIG, SA, 5087 We do not accept products that have been repaired or opened by other parties for warranty assessment.
Kindly make sure that all parts (even broken ones, etc) are included so we can assess the damage and confirm or otherwise if it is a valid warranty claim. Any failure to supply in full all parts and completed forms, will result in an automatic warranty claim denial.
For the warranty assessment, we use a third party professional to determine what has happened and how.
Their determination is final.
Kindly note that all return shipping and handling is not covered by Adore Tackle. Return shipping fees are the responsibility of the customer.
We do not take any responsibility for goods returned lost in transit.
Any goods that are supplied under replacement shall be supplied EX WORKS, ADORE TACKLE warehouse, Adelaide.
Any freight, insurance, taxes, imposts, duties and levies etc. (if and any applicable- to and from our warehouse) will be to the Buyer’s account.
Goods will be repaired during the Warranty Period (if the warranty claim assessment has been positive), free of charge, at our facility providing that they are returned to ADORE TACKLE facility, freight paid. Should ADORE TACKLE be requested to carry out work under warranty and find that the fault lies outside ADORE TACKLE’s responsibility; any cost involved will be charged to the Buyer’s account. The shipping costs associated with sending a replacement item under warranty are to be covered entirely by the buyer.
This warranty is in lieu of all other warranties expressed or implied and is Buyer’s sole and exclusive remedy in the event of defective merchandise. This warranty does not apply to replacement or repairs which are required as a result of negligent use, maladjustment, modification, abuse, tampering, physically damage or lack of routine maintenance. This warranty does not apply to any items considered to be of consumable nature such as gaskets, lubricants, seals, washers, etc. This guarantee also does not cover any form of surface coating, e.g. paint coatings, etc.
The provisions of these guarantees are in addition to, and not a modification of, or a subtraction from, the statutory guarantees and other rights and remedies contained in any applicable Australian laws. To the extent that any provision of these guarantees is inconsistent with any applicable Australian law, such provision shall be deemed voided or amended as necessary, to comply with such Australian law.
Due to market circumstances and product availability, we reserve the right to withdraw any advertised product and change prices without notice.
